Legal Question in Criminal Law in Virginia
Fraternazation
prison nurse gets involved with inmate she slips him a cell phone and he gets caught with it. She quits her job before prison finds out that she is the one who gave it to him, but his family finds out she gave it to him and they pressed the prison to get her put in jail. Prison investigators are going to question her about the situation.Should she talk to them without a lawyer, what type charges does she face and what type of prison time could she recieve for this being a first time offense?

No one who might face criminal charges should ever, ever talk to law enforcement without an attorney present. If approached, she should say only, "I want an attorney" which stops any questioning. She should not go anywhere with any law enforcement personnel unless actually under arrest, and she should never sign anything admit anything or consent to a search no matter what. She should consult a lawyer as soon as possible. If she is a union member she should consult her union rep.
