Legal Question in Criminal Law in Virginia
Fraudulent Alimony
If a recipient collects fraudulent alimony for a total of 12.5 years because she does not disclose her income threshold to her ex-husband under a court order, is this a criminal offense of fraud? It is over $55 before interest. Will a commonwealth attorney prosecute this case?

Re: Fraudulent Alimony
No, if it's fraud, it would most likely be the civil rather than the criminal version, and your possible remedies would correspondingly lie in the civil rather than in the criminal arena.
