Legal Question in Criminal Law in Virginia
my friend got a charged having concealed merchandise. went to court charge was dismissed.now he indicted on same incindent now named petty larceny, can that be done

Charges may be nolle prossed and brought back. The police officer or prosecutor probably thought the defendant was better charged under the petty larceny. There is limit on how much time the Commonwealth has to charge with misdemeanors.
