Legal Question in Criminal Law in Virginia
I have a friend who is in jail. He tried to leave a woman house and she would not allow him to leave, she kept blocking his way, a scuffle happened, they both have marks. Hours later she called the police and said he chocked her, a restraining order was given. The next day when he found out that she went to the police and a warrant was out on him, he turned himself in. Before he knew about the restraining order SHE text him; he went to jail on a Sunday, she came to visit him in jail on Thursday, the first visitation day. She later wrote him a letter, sent him a birthday card, and sent him money. She wants to drop the charges, the commonwealth lawyer will not let her; can she testify against him after writing, visiting him while he is in jail?
