Legal Question in Criminal Law in Virginia

My son was murdered 1-13-2008. He had broken up with a girl and went over to parents house to get his things. Her stepfather didnt like what he said and went upstairs, retrieved a 38 special with hollowpoint bullets, and murdered my son in cold blood. The monster is charged with murder. My question - the girl has been banned from our home prior and now we hear she has been at our son's gravesite. How and can we stop her from being there. It is a public cemetary, but if we see her there, it will be trouble. She causes my son's murder. Thank you for your guidance.

If the girl did not murder your son, you should not have any cause for any legal action against her. Her stepfather did the crime, not her. You have no legal remedy in my opinion.
