Legal Question in Criminal Law in Virginia

Need guidance on what rights one have against false charges being filed. On particular assault charge where no police was called it's just their word against your word. Also can previous charges be used if it was dismissed. I am fighting a assault charge were the prosecution is using past charges over 6 years ago that were dismissed. Can that be used?

A judge or jury can weigh evidence and determine who they believe to be credible.

A prosecutor can normally bring in question as to whether you have been convicted of felony

and/or crime of moral turpitude. In some cases, they can bring in past convictions to show motive, intent, knowledge, the pattern of a criminal etc....Bad acts questions are objectionable

in many circumstances.
