What could happen if you are charged with drunk in public and assault and battery on a police officer?

You might go to jail on the A&B charge(if convicted) but not on the DIP charge which involves only a $500 fine at most.

There is mandatory time with an assault and battery on law officer if found guilty. Being voluntarily drunk in Virginia is not a defense. It may be used in negotiating if you are looking for deal.
