Legal Question in Criminal Law in Virginia
I hired an employee here in Virginia that stole money from me. I went to the Magistrate and asked what to do and filled out some papers and he said a misdemeanor larceny warrant would be issued but since she was an employee and had possession of the money it would be embezzlement. I believe the warrant was for larceny. Does embezzlement come into it? Thanks.

The local prosecutor can always amend the charge to embezzlement should such prove necessary.
