Legal Question in Criminal Law in Virginia
Is this identity fraud?
A friend of mines had an affair with her neighbors husband. The wife turned around and posted my friends name and number on craigslist in an ad seeking married men (in other words, saying if you want married men, here you go,,,,maybe you'll leave mines alone). My friend is now wanting to sue her for identity fraud/theft. I told her I don't think she really has a case. The wife didn't gain anything from it. It was just like a highschool prank where the girls write you're name on the bathroom wall! I think she got what she deserved and it could have been a lot worse. Maybe I'm wrong. You're opinion would be greatly appreciated.
