Legal Question in Criminal Law in Virginia
I had a incident with my spouse and he was arrested for domestic violence, he is now wanting me to retract my statement since this is his 3rd offense automatic felony, what is the pro's and con's of doing that?? What would happen to me in teh future if i did retract my statement? the statement i gave is not false in anyway but we are wanting to work on our marriage and i'm a homemaker and he has a huge chance of losing both of his jobs..please help any advise is great!!!!!

This is attorney Sheryl Shane. It is not up to you at this time to decide whether to drop the case. If your spouse has already been charged it is up to the Prosecutor. In addition, I would not speak about strategy on this type of case over the internet. Your husband needs to hire an attorney and speak with her/him. When you ask questions - there may be a conflict since you are the alleged victim. If he is the client - let him ask the questions.
