Legal Question in Criminal Law in Virginia
My Juvenile - 13 yrs old
The police arrested my 13 yr son from the park, I was told the witness was riding by in the police car and looked and identified him in a robbery about 45 min ago. The charges was robbery, comission of felony with a firearm. I was told they saw him threw the beebee gun to the ground. He's never been in trouble ever, He plays sports for school all year round. He had just the left the house around 4:15 and the police called me at 5:32. Does a juvenile have a right to have an attorney present and do they have the same miranda rights and do I have the right to get a copy of transcript of what was said in the interview?

Yes, a juvenile has a right to have an attorney not only present but representing him at all stages of the criminal proceedings against him, and for the serious felony charge which has now apparently been filed against your son, you should spare no haste in retaining as quickly as possible a competent criminal defense counsel to defend him in this matter.
