A Class 6 felony is the least serious of the six classes of felonies recognized in the Virginia Criminal Code and carries a possible penalty of one to five years in the state penitentiary or in the discretion of the judge or jury trying the case, up to 12 months in the local jail and a fine of up to $2500, either or both.
