Legal Question in Criminal Law in Virginia

I live in VA and during a bar fight I grabbed a cell phone which I thought was my friends. I got arrested for drunk in public and grand larceny. This is the first time I have ever been arrested once I got out of jail the next day I took the phone to the Police station so they could give it to the rightful owner. I have a preliminary hearing on 10/22/10 what are my chances of getting it thrown out of court or marked down to a lesser charge. I cannot imagine being a felon over a drunken mistake. The phone retails for $400 but with a plan from sprint it is only $199.99 under the grand larceny limit by 1 cent. any help or advice is appreciated

My second piece of advice would be to discuss the case with no one except this
