how long does a non processed charge last in the state of virginia

A misdemeanor charge nolle prossed can be recharged (brought back) by the local Office of Commonwealth's Attorney for up to 12 months from the date of
the crime alleged.
For a felony crime nolle prossed, there is no such limitation.
