Legal Question in Criminal Law in Virginia
Maliciously Throwing a Missle at Occupied Vehicle
My dad was recently charged with maliciously throwing a ''missle'' (ie brick) at an occupied vehicle. (nasty form of vigilantly justice...the ''victim'' was drag racing in front of my parents home). In VA this is a class 4 felony but no one was hurt and his record is clear other than this charge (and the drunk in public that went with it). I understand this carries some pretty hefty penalties. Can he get off with only probation and fines? What are his options? Is he doomed to prison?

Re: Maliciously Throwing a Missle at Occupied Vehicle
Yes, your dad should have a competent criminal defense counsel representing him in this matter(if he doesn't have such already)which you've correctly identified as a felony offense in the Commonwealth.
There was a lady convicted in Stafford County, Virginia, of this very offense about year and half or so ago and the jury gave her two years in the state penitentiary for throwing a Mcdrink into another vehicle.(The judge later shortened it to 30 days in the local jail.)
Your other questions are best answered by the lawyer who will be defending your dad in this case.
