Legal Question in Criminal Law in Virginia

Minor in Possession of Alcohol

I was at a party with underage

drinking, quite a few of them being

under 18. I'am 18 and blew a .005 i

believe and got charged with minor in

possesion. Before I took the

breathalyzer he asked if I had been

drinking. I said no. I assumed that

when I took all those D.A.R.E. classes

on drug prevention that the info was

correct. They explained .02 is the

legal limit for anyone under 21.

What should I do?

Re: Minor in Possession of Alcohol

Minor in possession under Va. Code Sec. 4.1-305 is a class 1 misdemeanor offense and, therefore, if at all possible you should have an attorney represent you who should be able to arrange for a deferred disposition of this matter (if you have no prior criminal convictions and are able to complete probation successfully).
