Legal Question in Criminal Law in Virginia

How to get a ''Monster'' off my back!

Under what (if any) conditions would a person be able to have a (assault and battery against a family member)conviction expunged off their record? I took a plea agreement even though I was not guilty in order to just get away from my now (as of 3/10/06)ex-wife. I took a 24hr. incarceration as opposed to going before the judge. I have kicked my backside ever since for not going before the judge! I felt a one day certainty as opposed to a possible 2 Year sentence was a better route to take. Is there anything I can do about this or did I seal my doom for life to have this hanging over my head?? Please help if you can and THANK YOU in ADVANCE!!!!

You have sealed your fate unfortunately. Expungements will only be granted after a finding of not guilty or dismissal by the prosecutor. Your only option would be to petition the governor for a pardon, but the chances of accomplishing that are slim to none.
