Legal Question in Criminal Law in Virginia

is it negligent homicide or involuntary manslaughter?

a person works for an answering service & fails to do what a client has instructed them to do to contact their after hours oncall personnell. the client is a hospice, and a patient passes away shortly afterward, apparently as a result of this failure. can the person or answering service be charged? & if so, what are the possible outcomes?

Re: is it negligent homicide or involuntary manslaughter?

No, I doubt very much that any criminal charges could arise from the scenario described involving a hospice which by definition is a residence for the dying. It could be possible, nontheless, that the hospice and/or its employees might be charged civilly with some form of negligence for failing to act expeditiously in whatever matter is being alleged.
