Legal Question in Criminal Law in Virginia
NSF check ramifications
My wife was convicted of writing a bad check. We paid the debt prior to the court date. The documentation of payment
was introduced to the court. She was not represented by a lawyer in court and she was found guilty. This was in 2000 now she is having troulbe getting a job. The criminal report reflects the status of paid but also of guilt. Can this be removed/changed? What process is involved?

Re: NSF check ramifications
Apparently, your wife did not make good on the check within the five day notice period which is required under the criminal statute.
Unless your wife can prove that she was wrongfully convicted of this offense, it cannot, now, be expunged.
