Legal Question in Criminal Law in Virginia
What does null process mean? I was recently charged with petty larceny.....then they apparently dropped the charges and filed for a null process to change my charges to felony embezzlement. &ow;long do they have to file that charge? And its been almost a week since they court date so why hasn't he filed it yet?

Nolle prossed, means that the court dismissed the charge on motion of the prosecutor. "'They", i.e., the prosecutor's office has ample time to
refile this felony charge since there is no statute of limitation applicable
to felonies in the Commonwealth.
