Legal Question in Criminal Law in Virginia

What does null process mean? I was recently charged with petty larceny.....then they apparently dropped the charges and filed for a null process to change my charges to felony embezzlement. &ow;long do they have to file that charge? And its been almost a week since they court date so why hasn't he filed it yet?

refile this felony charge since there is no statute of limitation applicable

to felonies in the Commonwealth.
