Physical Assault

While driving my car, I changed lanes with proper indicators and safe distance that resulted into a cut for the car behind. The driver got really mad and started honking along with tail-gating. To avoid any conflicts, I took the immediate right - but the car driver followed me. I stopped at the next red-light and the driver of the car following me came up to me and started cursing. He than opened my door and started hitting and punching me on my face and head. There on he just ran away. I got his License plates and have pressed charges against him. 5-6 people saw this incident and volunteered to be a witness. The fight resulted into swelling, cut and scratch on my face. What kind of punsishment can be given to this driver?

The criminal charge under Virginia law, based upon your description of the facts, would be assault and battery. Assault and battery is classified as a Class 1 misdemeanor, punishable upon conviction by a fine of up to $2500 and/or up to one year in jail.

This motoring miscreant may also be liable to you for civil damages.
