Legal Question in Criminal Law in Virginia

Plea Bargins

My Brother is in jail for 3 felonies. He took a plea bargin. He is currently serving his time. In the transcript from the court there are many areas that contradict each other. Is it possible for him to appeal the case? Or is there someone we can send the transcript to? That may be able to help?

Re: Plea Bargins

If your brother took a plea bargain, then he gave up his right to appeal his conviction. No matter whether there are inconsistencies in trial testimonial or other evidence on which the verdict was grounded, he nevertheless waived his right of appeal based upon these kinds of grounds, once the court accepted his plea bargain.

Therefore, the answer to your question must be no, unless the sentence itself which he received for the conviction was somehow illegal.(Not likely.)
