Legal Question in Criminal Law in Virginia

Polygraph Test requested

My neice took her baby to the hospital for fever/kidney infection. The hospial said the baby (11 weeks) has a cracked rib that is healing. After grilling her at the hospital and CPS she is a mess. Her husband is in the Navy and at sea. She does not abuse her kids. the only thing she could remember is when her Mom was in a car accident on 4/17 with her 1 year old in the car. She went got to the site, seen and abulance, police,her moms totaled car and no son. She grabbed the baby out the car seat and ran. They asked if she would take a polygraph test, she said yes. Now, they have called her and want her to come in tomorrow for the test. I feel she is so upset that she will not pass and she needs to talk to an attorney(which she can--name removed--afford). Can she ask for an attorney if she has not been charged ? Will this look worse for her if she refuses ?

Yes, your niece would appear to be well advised to retain the services of a criminal defense counsel at this stage of matters and needs the permission of noone to do so irrespective of whether she's been formally charged or not.
