Legal Question in Criminal Law in Virginia

Possession of Fake ID

I am a 19 year old, straight-edge, college student who was charged with possession of fake id. I have no priors or record. I have been searching for information on what is going to happen, whether or not I need a lawyer, and if I can get this expunged from my record. I would appreciate any advice.

Re: Possession of Fake ID

Assuming that you've been charged with violating Va. Code Sec. 18.2-204.1, this is a Class 1 misdemeanor offense(up to 12 months jail and/or a fine of up to $2500), you'll need a lawyer, either retained by yourself or appointed by the court.

If you're convicted of this offense, you can forget about having the record of it expunged. Expungement of criminal convictions in the Commonwealth is only available to those who have been wrongfully convicted and can prove it and, consequently, have received a full pardon from the governor for the offense. See Va. Code Sec. 19.2-392.2
