Legal Question in Criminal Law in Virginia
prescription fraud
A friend was charged w/felony prescription fraud to obtain schedule II narcotics. She was put on two years probation on a ''251'' (no more problems for two years and the charges are dropped). While still on probation, she was charged w/prescription fraud again, this time for attempting to obtain Schedule III narcotics. Is jail inevitable here? She has a good lawyer, but what is the best she can expect?

Jail is not necessarily inevidable, but its possible. Its entirely up to the judge. Generally speaking, most judges view probation not so much as a sentence, but rather an opportunity for the defendant to correct a mistake. When a person violates probation most judge take a dim view on it.
