Legal Question in Criminal Law in Virginia
PreSentencing report
I reside in virginia beach virginia. my husband is incarcerated here also and when we went to court the judge wanted a presentencing report done. that was over a month ago close to two. His sentencing date is december 8th but it does not look like the report will be done by than even if it was finished today it still has to go over to my husbands attorney and than he needs to go over it with my husband so it looks like we will have to have the case continued.my question is does probation and parole have a certain amount of time to do this report or is it they get to it when they get to it? thanks for your help on this.

Presentence reports are normally due well in advance of the scheduled sentencing date in most courts in my experience.
