Legal Question in Criminal Law in Virginia
I am on probation for forgery of a prescription. I have a doctor and get prescriptions every 2 weeks for pain and my probation officer knows this. I have to just tell her when and what I get prescribed. And if I go to the hospital just inform her. I went to the er cause I fell and broke a tooth and the er doctors gave me a prescription for codeine and one for a antibiotic. Now she wants to try and violate me for something prescribed to me. Can she violate me for this even though I haven't broke any laws?

Sure, the probation officer could try, but when the matter comes for a hearing before a judge on your alleged violation, on these facts it should be dismissed and you should likely be restored to your original probation.
