Legal Question in Criminal Law in Virginia
Can't get property that was recovered by police.
My house was robbed over a year and a half ago. Some of my property was recovered. The trial date was continually pushed back until recently. The accused person was summoned but didn't show up in court and now they can't find her. To me she proved her quilt. Why can't I get my property back from the police? Will I ever get it back, or will it remain evidence until she's caught?

You should contact your local Office of Commonwealth's Attorney and ask to discuss it with the prosecutor assigned to the case. The prosecutors continue to hold your property because they apparently need it to prosecute this person who is now on the lam. Perhaps, however, at least some of it could now be returned to you at this point and it certainly would not hurt to ask.
