Legal Question in Criminal Law in Virginia
Was pulled over and arrested for having an amount of marijuana which is a felony they took me to the station did not process me and they took the drugs and let me go home.
the question is can they now come back pick me up and try and charge me?

They have one year to bring charges against you with misdemeanor. They have forever to bring the felony against you. Atleast as the law stands now. Sometimes, the police wait to determine what the forensics report states prior to charging. They may also try and get you to cooperate in exchange for not bringing the charge.
