Legal Question in Criminal Law in Virginia

Question about FTA

Could you please answer a question for me if you can? If a FTA warrant is issued for missing a court date for a DUI (only one party invloved), is there a statue of limitations for when that warrant will be erased or go away? The DUI was in Virginia and the FTA warrant will be issued in Virginia.

Thank you.

Re: Question about FTA

There is no statute of limitations applicable

to the FTA warrant. Once the warrant is issued, the defendant is considered a fugitive and, consequently, the statute of limitations is tolled(stayed). The warrant can remain active in the various law enforcement databases quite literally for years, waiting for the subject of the warrant to be stopped by police for some other unrelated, seemingly innocuous matter, such as a traffic stop.

However, you can be assured that in the Commonwealth of Virginia, the authorities will not sit back and passively wait for the subject of this kind of warrant to fall into their snare; they will, rather, proactively seek out this law evader and arrest him or her as expeditiously as possible.
