Legal Question in Criminal Law in Virginia
Reconsideration Letter To Judge
My friend has been sentenced to 4yrs. for a probation violation. He was instructed to write the judge a reconsideration letter to see if his time could be reduced. What are some tips to writing a good letter, and what type of info should he include? He has been in trouble in the past, and on probation since he was 15yrs. old now 27. He has children now and would like another chance. H e recieved 4 yrs for driving w/out a license.Any good ideas?

Re: Reconsideration Letter To Judge
The attorney who represented him either on the underlying charge or the probation violation itself would be a good person for your son to consult on this matter.
Nevertheless, as a general rule in these matters, judges like to see the appropriate expression of remorse from the petitioner as well as his or her thoughts on what led the person into the commission of the probation violation(mitigating factors, if any) and what steps are to be taken in the future to avoid a repetition of the situation, e.g substance abuse counseling, marriage counseling, other therapy, etc.
Also, for the defendant who has family responsibilities, a closing line or two in the letter referencing the obvious importance of the defendant returning to his family as quickly as possible in the interest of lessening the exacerbation of whatever familial fractures which may have already occurred, will almost always help the cause.
