Is it legal in the state of Virginia, to record a conversation via telephone or in person without the other person knowing the conversation is being recorded?

Taping phone conversations -VA
As long as at least one party to the phoneconversation consents, taping is legal in VA.

Taping of conversations
It is not illegal in Virginia to tape a conversation to which you are a party. The tape recording of a telephone conversation may not be admissible in evidence, however, at least in civil cases, unless the party being recorded knew of the recording.
