can i ask for a refund from a lawyer that I want to fire?, he only appeared with me in court one time and I'm currently awaiting trial

Yes. Notify the lawyer that you no longer want him on the case and request an accounting and a refund of any unearned fees. The lawyer may bill you for time spent actually working on the case (which is usually a lot more than you probably think), but must refund any portion of your retainer not actually earned.
