Legal Question in Criminal Law in Virginia

Refusal to return property

About a year ago, I lent a girlfriend of mine a shotgun as she was living alone in a remote, rural area in which a registered sex offender lived within 2-3 miles. We had a falling out, and she has failed to return the shotgun to me since December, despite me having asked for it back on numerous occasions. She claims it is in a storage unit and that she hasn't had the time to move things out of the unit to get to it. After nearly 4 months I've had enough. What legal options do I have to get my property back?

Re: Refusal to return property

You may file in your local general district court an action called a warrant in detinue for the return of your property, or, in the alternative,

a request that a judgment be entered by this court against the wrongful withholder of the property(shotgun)for its fair market value.

Just go to the clerk's office and tell them what you want to do. Make sure that you have a valid address where the defendant can be served with notice of your lawsuit.
