Legal Question in Criminal Law in Virginia
I am representing myself in a trial de novo for misdemeanor. ( 3 counts) that I was convicted of. My previous lawyer poorly represented me and failed to present key evidence at the initial trial. So this motion is to dismiss the charges based on the facts and evidence that was not presented.

Such a motion will necessarily fail and is a waste of time (not only yours but also the court's).
Your far better course is to be prepared at your trial de novo in the circuit court
to present this evidence which you claim your former attorney failed
to present in the general district court and which you believe could help
in your defense against these criminal charges.
