Legal Question in Criminal Law in Virginia

I was riding with my ex-boyfriend,he went the wrong way and we startd arguing.He turned the radio up,I immediately turned it back down and he slapped my hand down so I slapped his down hard.Then he hit my face openhanded,and I reachedover and scratched him and he pulled over.He threatened to drive the car off a bridge into a river and got off on the next exit which was a bridge and stated swerving,I called the police and told them what was going on.Once he realized I called the police he kept straight and pulled over by the toll right at the bottom of the bridge.When the police came,my ex told them he lived with me and they saw he had been scratched and bleeding and they said they couldn't tell if my woulnd to my lip was fresh because it wasn't bleeding.So I ended up arrested and couldn't go to MY house for 3 days because they said it was cohabitation.
My question is A.How do I proove we were not cohabitating(I have my mom's testimony that he was NOT living with us)he had stayed over sometimes because he took me to school but we were not a couple or anything.and B.How do I proove self defense?I want to get a recording of the 911 call,but they said they can't give it to me because under the Freedom of Info.Act,you can't give it out if there's a pending criminal case.Is there any way to get around this?PLEASE HELP!

My only ? is why you haven't retained a competent criminal defense counsel to

represent you in this "pending criminal case" or have asked the court to appoint

one for you in case you can't afford to hire such on your own.
