Legal Question in Criminal Law in Virginia
I was served with a search warrant at my house. My son had come home just before the police arrived and parked his van in the driveway. One officer asked him if he could search his van which he said no to. But the other officer had already began searching the van and found what they were looking for in the house they found it in the van. Is the search of the van legal or can a lawyer have it thrown out?

If your son did not consent to the search of his vehicle, his lawyer
should file a pretrial motion to suppress the contraband evidence
which was found in his vehicle as a result of this nonconsensual search.
