Legal Question in Criminal Law in Virginia
shoplifting employee
if a store employee swapped an item for a similar item at the store (thinking the two items are similar in price since the price tag was missing). Other than termination for not comply with store policy, can he/she be charged for shoplifting?

Charged, perhaps, but not likely convicted of shoplifting if the accused lacked the requisite criminal intent(mens rea).
