Legal Question in Criminal Law in Virginia
Sis
What possible consequences does the Suspended Imposition of Sentence (SIS) have on the future life? The charges were misdemeanors with up to 1 year imprisonment. Will it affect a job application for a senior management position in a corporation, security clearance? Could you please list all possible consequences on all aspects of life. What are the possibilities for expungement except with a Governor of a state? What are the ways of proving that a policeman lied in court? Policeman told a magistrate one thing and totally opposite thing in court. A friend of suspect came and spoke with a magistrate before the suspect ever talked to a magistrate. The magistrate told a friend what the suspect will be charged with and listed the facts how policeman described them. However, policeman totally changed facts in court, facts were different from what he told the magistrate. It's not possible to subpoena a magistrate. There was a second policeman present at the scene of suspected crime. HOwever, this second policeman might lie also if the case will be applealed to a Circuit Court. So, is there any way to prove that policeman lied? THe only proof is that the magistrate told a friend of a suspect the original story of the policeman.

Re: Sis
For the defendant who receives the disposition
of SIS for his criminal charge in the Commonwealth and successfully completes all of the terms of his probation, the case is closed by the court after one year and there is no record of any conviction since the defendant was never officially sentenced, and he may truthfully swear
before any court, agency, tribunal, or on a document that he was never convicted of that particular criminal offense with which he was charged.
Given all of the above, the consequences for the defendant who receives the SIS disposition should be either minimal(the arrest record is still there)or non-existant and there is no need to attempt to pursue the remedy of expungement since after one year the SIS case is effectively expunged.
