Legal Question in Criminal Law in Virginia

Solicitation of Prostitution

It is a misdemeanor in my state. It boils down to my word against the undercover police officer as to which one of us initiated the transaction. There was a partner, supposedly listening in. What is a good defense for this case?

Your word, you say, against the undercover police officer's? An officer who apparently had a partner listening in to evey last incriminating word that you undoubtedly uttered in this aborted vice transaction?

Whom do you think the judge is going to believe if this matter goes to trial, you or the officer(s)? "What is a good defense for this case", you ask?

Under these facts, I would say there ain't any. Better be shopping for a plea bargain through your criminal defense counsel.

I agree with Michael. I think you wanted an attorney to say entrapment but that only works with the person entrapped had not had a previous inclination to commit the crime. So unless you were walking down the street on your way to church and the undercover cop said, "I will give you ___ for $20.00 because I need the money to feed my five starving children."

Get a local attorney to help you. He or she may be able to get a plea deal.
