Legal Question in Criminal Law in Virginia

State to state transfers

My husband and I would like to move to Virginia to start a new life. He was accused of Sexual Assualt on a minor in 2001. We could not afford a proper Attorney for his defense because we are a low income family. So instead of spending his life away from is family, he pleaed out to a 2 year sentence in a county jail and 5 years probation and a life time of parole. He has been forfilling his oligations to his sentence and has not had any trouble for one year. my question is Massachusetts states that they will not grant him a transfer to Virginia because of the parole obligation of his sentence, What can we do to have this part amended or dismissed or is there any way we can move to Virginia, Please help have no where to turn. Thank you.

The issue you have raised must be resolved in Massachusetts, not in Virginia.

As long as he's not in violation of any of the conditions governing his release, your husband's probation and parole should be transferable to Virginia. It may be that you have not been speaking with the right people in the Probation and Parole Office of Massachusetts (or whatever it's called up there).

These kinds of transfers are routinely made between states.
