Legal Question in Criminal Law in Virginia

Is it really Statutory Rape?

im 16 years old I have a boyfriend of 4years whose currently just turned 19. Seems like everything was fine until he hit 18yrs old thats when my mom started giving him pressure trying to have him arrested etc.etc. I was wondering can he really be locked up for still going out with me? Because in my state(VA) They say that 16 is the legal age limit and if the other person is over 18 it has to be a 3 yr lage imit. My social worker said it is ok because we're only 3 years apart nothing can be done, I was wondering if this is true. I love my boyfriend and don't want to see him in any trouble because he has no record. I also wanted to ask what happen if i become pregnant?

Back in September I was 2mths and had a miscarriage and my mom disregarded but she said my boyfriend still could be locked up. I don't understand cause one minute he can't and one minute he can. So if you or anyone can help me please do.

Re: Is it really Statutory Rape?

The threshhold age for charging statutory in the Commonwealth is below 15 years for the allegedly consenting

minor. However, before you exhale too many sighs of relief, I would suggest that you seriously review your admitted wayward conduct thus far with your 19 year old boyfriend which, if it continues, will very likely end for you in a most unhappy and regret filled way.

Correction: the prior answer should read "statutory rape".
