Legal Question in Criminal Law in Virginia

stolen motorcycle

my ex left his motorcycle with me when we split up. it is still titled in his name, but has been in my possession for nearly 5 years. i parked it at my parents all this time and a neighbor inquired about buying it from me. i told the neighbor i had no title and wasnt sure it would run. he said he wanted to take it to his garage and check it out. i agreed to let him take it, only to decide on what he thought it was worth. a month later, i get a call from a guy who said he bought it from the neighbor! he refuses to give the motorcycle back and i have yet to hear from the neighbor! what can i do? without the title can i report it stolen?

Re: stolen motorcycle

Contact your ex and have him sign over the title of the cycle to you. (If he no longer has it, he should be able to get a duplicate title from the

DMV.)

Once you have the title signed over to you, you could then go to your local general district court and file what's called a Warrant in Detinue against your neighbor demanding the return of your property or in the alternative, a judgment against him in the amount of its fair market value plus court costs.
