Legal Question in Criminal Law in Virginia
Can this terribly serious case be dismissed?
The accused, first time offender, charged w/ dist of cocaine & heroin, consp to dist, dist to person 17.6 years of age (his girlfriend) who's a mother of 4-year-old child. The minor was the one the trailer was leased to. There is video from cameras set up in trailer w/ only landlords permission. Video contains explicit sexual acts, other private-domestic occurences. To his disgust, appointed counsel said there's hours of him engaged in sexual acts, etc. Isn't this an invasion of privacy, since nobody living in the trailer gave permission to set up cams in residence? Can they actually convict of minor charges if the girls mother assisted in their living together, and minor is also held on charges from the same case, being tried as an adult? Can you actually try one defendant for crimes dealing with a minor if state is charging minor as an adult? The accused is a victim of a prior shooting/robbery attempt against him that has caused Post Stress, that ultimately resulted in his drug addiction, and his current incarceration.
