Legal Question in Criminal Law in Virginia

have time reduced in prison

Have a friend sentenced to 9 years in prison for assault on family member and elude police..Recently while in prison they have diganoised him with attention deficit explosive disorder..Is there any way to have his case review with this new finding..Even if he has already served 3 years of his sentence so far...Any insight to this would be very helpful.

If your friend was afflicted with this disorder which may have contributed to the crime of which he was convicted and incarcerated, and his attorney failed to properly investigate this matter and raise this particular issue at the appropriate stage in his trial, the defendant may have a basis to now bring an action before the appropriate court asking for habeus corpus review of his case based upon the alleged ineffective assistance of his counsel.
