Legal Question in Criminal Law in Virginia
I know someone,(not myself) who got a traffic ticket for speeding.120 in a 55.She chose not to go to court and got a capais. That capais was served when she got caught reckless driving and a new court date was set,She was allowed to sign her own bond at that time. She chose not to go to court again and a second capais was issued. The capais has not been issued yet,the court has sat 3 court dates for this second capais. This is the 4th attempt to serve the capais. My question is what happens if the police don't find her to serve the capsis. Will she be declared a fugituve or what?
1 Answer from Attorneys
Yes, she will probably get her very own fugitive file set up with that particular court (if she doesn't already have one) and her name distributed through all the law enforcement databases which that particular court deems appropriate.
