Legal Question in Criminal Law in Virginia

Unathorized use of a vehicle

In November 06, I took my sister's car with out her permission and she got upset and called the police on me. Now my license is revoked until February 08, 2006, but the police officer did not charge me with driving on revoked he just charged me with Unathorized use of a vehicle. The court date for this incident is on February 05, 2006. My question is, Even though the police officer didn't charge me with driving on revoked, is it possible for the judge to decide to suspend my license longer because I was driving the car and even though that is not the charge?? Do you think he could take in to consideration that I am supposed to get my license back in three days after it being suspended for 1 year and 3 months?

A license is not usually suspended on am unauthorized use conviction. On the other hand, lawyers and judges can

come up with all types of sentences if they choose. There are limitations according to statutes. I believe you will be ok regarding license. Nothing is a promise. I always suggest hiring an attorney.

The judge is unlikely to involve him or herself in these kinds of deliberations, but, will most probably follow the lead of the prosecutor as to what the offense (and consequent penalty) may be for which you are to be convicted.

You should be represented by an attorney in this matter in order to minimize the possible adverse consequences.
