Unauthorized ATM use

Friend & wife are separating. 6/11/09 they go to bank to remove her from joint checking account. She would continue use of her old checking account. She was to cut up ATM card and did not. She removed $50 from his account on 6/21/09 & told him by accident in a conversation they had the next day. What charges can he bring to her?
