Legal Question in Criminal Law in Virginia

My sister was found guilty of a felony for receiving a package that was delivered at her house. The judge was going to dismiss my sisters attorney was working with the prosecutor and filed a null contendo. The judge took it underadvisment for two years now the prosecutor wants to have her charged for writing a fiction book about the ordeal. is;t this against our constitution?
